AP High Court Order against 4% Reservations for Backward Muslims. Govt embarassed, will appeal in SC.
Feb. 8: Muslims of Andhra Pradesh, and the govt of AP suffered a setback, Lakhs of Muslim Boys and and Girls, hope to find their place in field of education and jobs spent sleepless night, with their future plans and hopes in balance in Courts.
As AP High Court in a majority decision on Monday struck down as unsustainable the legislation providing four per cent reservation in educational institutions and government jobs to backward groups among Muslims.
A seven-member bench headed by Chief Justice Anil R. Dave was divided 5-2 and provided three different decisions while striking down the legislation. Justice Dave while pronouncing the verdict on his behalf and on behalf of Justice A. Gopal Reddy, Justice V. Eswaraiah and Justice G. Raghuram opined that the legislation failed to define the expressions “Muslim” and “other Muslim groups.”
The Act violated Articles 14, 15(1) and 16 (2) of the Constitution. The court faulted the surveys relied upon by the BC Commission to enumerate Muslim backwardness. The commission’s own survey was “not sufficient,” it said.
The court struck down the AP Reservations in Favor of Socially and Education-ally Backward Classes of Muslims Act, 2007 and the Government Orders Ms 23 and 231 to provide reservation for Muslim.
Lakhs of Muslim boys and girls, in preparation for approaching intermediate, and emcet exams. The reservation for the backward and the disadvantaged in the Muslim community gave the needed start to the trend in the Muslims to go for proper education, and gradually but surely raise the bar of percentage of literacy in Muslim backward community.
The admission so far made under this reservation policy of 4% since 2007 will not be effected. But the future admissions or admission hereafter may get blocked. The govt of AP acted apparently swiftly to go for appeal against the order of High Court in Supreme Court, immediately.
The Muslim organizations, like MEC Minorities Empowerment Council, demand restoration of the reservation policy, in consultation with legal experts, and represent, appeal without any delay to the Supreme Court, with determination and zeal. Read more…
Govt. Comissions to assess condtions of Minorities is fine, but will it implement, their recommendations with same sprit ?
Many commissions are formed with sincere desire by the govt. to help the minorities and give them their rightful place in the society. Many surveys and commissions proved time and again that the minorities on India are left out and are a backward, in many areas of education, economic, social life. since the independence the condition of muslim minorities in particular has not shown signs of growth as it should have. The minorities are supressed and disadvantaged due to their economic, educational and social backwardness which is growing as the years and decades pass by.
Why the Minorites are backward
Their backwardness has given way to very odd and unhealthy colors to some of them, as we know economic and education backwardness make an individual weak, he becomes the weak link and these elements due to personnel insecurity become tool in the hands of opportunists and evil masters of the anti-social colors.
There is factor contributing to this backward trend in minorities first and foremost the lack of inclination in the minority community to educate themselves, the other factor the environment, support and counselling by the organizations to motivate them and educate them about the various governmental schemes available for them to give them the necessary support, one other factor is the leadership in the Minorities is not focussed on doing their bit to support them with organised effort and guidance and support.

However not all is dark as we like to present, the truth is the nation India is a the biggest democracy of the world with a billion population. The challenges faced by the country are big and diverse with voices, for and pro to all schools of thoughts and the diversity is bond to be influenced most of the times by the majority voice in the system we live in.
The govt of Dr. Manmohan Singh for the benefit of the minorities formed commissions and committees to study and report and recommend suggestions to the govt. for takeing concrete measures in order to uplift the Minorities of India, commissions such as the Schachar committee, and Ranganath Mishra Commission. The findings of both are now public and recently on the 9th of Dec the Ranganth Mishra Commission findings and with its suggestions is placed in the parliament for the process to start and take action on its recommendations.
Justice Ranganth Commission Recommendations
The report of the National Commission for Religious and Linguistic Minorities headed by former Chief Justice of India Rangnath Mishra, is considered a step ahead of Sachchar Committee report that went into the backwardness of minorities mainly Muslims.
The Commission, was notified in October 2004 and began functioning in 2005. Two years later, it submitted its report to Prime Minister Manmohan Singh in May 2007
With regard to quota, the Commission says that 10% should be reserved for Muslims and 5 % for other minorities in central and state government jobs in all cadre and grades.
It added that in case of non-availability of Muslims to fill the 10% earmarked seats, these may be made available to other minorities but in “no case” shall any seat within the recommended 15% shall be given to anybody from the majority community.
OBC “non-exclusion of ineligible” castes has hurt genuine backward groups.
The failure to exclude castes from the OBC list has led to a sharp increase in number of OBCs — provocation for Mishra panel to slam “political considerations” and “vested interests in remaining backward” for distortion of the system.
The purging of OBC list is a sensitive issue which saw the government plump for status quo when Mandal Commission completed 10 years in 2003 and the first exclusion exercise was to be taken up. Citing inclusion of Jats and Vokkaligas in OBC list as examples of “political compulsions”, the report said “non-exclusion of ineligible” castes has hurt genuine backward groups.
If the report’s comments threaten to touch a faultline in backward politics, its recommendation for 8% subquota for minorities within 27% OBC quota is a testing proposition too. The panel has suggested the measure for increasing representation of minorities in government jobs.
Dissent on the recommendations by Asha Das
Member Secretary of the Commission Asha Das has, however, given a note of dissent on the Commission’s recommendation for conferment of SC status on Dalit converts to Christianity and Islam saying there was “no justification” for it.
Besides, she has said that as Dalit converts to Christianity/Islam do not qualify for inclusion as SCs, they should continue to form part of OBCs and avail facilities and reservations given to the OBCs until a comprehensive list of Socially and Educationally Backward (SEB) is prepared.
The Commission has, however, rejected the contentions made by Das in the dissent note and said “(we) firmly stand by every word of the recommendations, we have made under this term of reference.”
Alternative Route Sujested by the Commission for satisfying the 15 % reservation for the Minorites.
The Commission also suggested an alternative route for reservation to minorities if there is “insurmountable difficulty” in implementing the recommendation for 15 reservation.
In this regard it said since minorities constitute 8.4 percent of the total OBC population according to the Mandal Commission report so in the 27 percent OBC quota, an 8.4 percent sub quota should be earmarked for minorities.
The internal break-up should be 6 percent for the Muslims, commensurate with their 73 percent share in the total minority population at the national level and 2.4 percent for other minorities.
Besides it has recommended that the reservation now extended to the Scheduled Tribes, which is a religion neutral class, should be carefully examined to assess the extent of minority presence in it and take remedial measures.
The Commission noted that the minorities especially the Muslims are very much under-represented and sometimes wholly unrepresented in government jobs.
Some are of the opinion that the reservations is not going to help the Muslims and the Minorities.
This can not be true in India one should understand that India since its formation was forced to protect and support its backward and supressed classes of populations, the scheduled caste, backward caste, on the basis of caste, social placement, linguistic, and economic backwardness. It is to be understood that the SC Sheduled castes are mainly the caste originating from the Majority Hindu community and it is found that the SC category Hindu when converts to other religious belief is deleted from the SC category and he will not be treated as a SC he will have to be considered in the religious minority.
Among a host of recommendations, the Commission recommends delinking of Scheduled Caste status from religion and abrogation of the 1950 Scheduled Caste Order which “still excludes Muslims, Christians, Jains and Parsis from the SC net.”
The Order originally restricted the SC status to Hindus only but was later opened it to Buddhists and Sikhs.
In such as set up when every class and section of the population is given reservation it becomes more important that muslims should be given reservation to make up for the gap both socially and economically between them and the rest of the Indians. If it is not done the effect will be multiple and the gap will be widened and will come to a level of apathy
National Effort to be made to influence and help the govt. to implement the recommendations at the earliest.
The Minorities across political party line, regional and cultural divides should influence and help the govt. with all available means to implement the recommendations of both the Ranganth Commission and the Sachar committee recommendations in true spirit.
This should be single point focussed agenda of all the Minorities of India.

The common perception among the Muslims was a Muslim will not be made the PM in India of which he is the citizen.
This perception was a danger syndrome for the young generation, and specially the children who is told that all Indian are brothers and sisters, our constitution gives all its citizens equal rights and equal opportunities with out discrimination on the basis of religion or caste and region.
Unless the confidence is induced in our young boys and girls at the level of primary school, the induction of oneness concept and the ambition to excel in life will not be present.

Hundreds detained with no charge in Isreal, human rights voilated.

Salwa Salah was 16 years old when she was arrested by Israeli forces and jailed for seven months.
Israeli court minutes said Salwa Salah, 16, had been involved in “planning military operations.”
To this day she says she does not know her crime and is struggling to get her life back on track.
She was released shortly before her final school exams but was unable to catch up and now has to re-sit before she can go to university.
Salah was held under administrative detention – detention without charge or trial. It is legal under international law which permits its use only in exceptional cases to protect the security of a state.
But human rights groups say Israel abuses this right.
A report released Wednesday by human rights groups B’Tselem and HaMoked has called on Israel to release the detainees or charge them. They say there are currently 335 Palestinians being held under administrative detention, three of them women, one a minor.
When asked about Salah’s case, Israeli prosecutors gave CNN the court minutes which read, “It has been shown that the prisoner was involved in planning military operations very close to the time that she was detained.”
Salah insists she is a schoolgirl and not a terrorist but no further information was given to her lawyer. Much of the evidence in these cases remains secret.
Sahar Francis, a lawyer from Ademeer human rights association said: “It is submitted to the military judge and me as a lawyer. I don’t have access to this file so actually I can’t defend my clients properly since I don’t know what the exact suspicion against my client is.”
- Salah said the prison conditions were fit only for animals and she found her time inside psychologically hard. “The prisoner does not know if he or she is going to be released or not,” she said.
“So sitting in a prison confused and weary asking ‘am I going to be released?’ You are distorted by this one question.”
Israel says administrative detention is a valuable pre-emptive tool in its ongoing war on terrorism and often evidence cannot be made public. Lt. Col Maurice Hirsch, Israeli prosecutor, said: “Most of the evidence is not shown to the detainee but rather is kept a secret in order to protect the lives of the people that provide the information and the technological means by which the information is acquired.”
The al-Hidmi family has found itself on the wrong side of administrative detention for many years.
One son Islam, 20, was held for twenty one months without charge or trial.
Two months ago there was an emotional homecoming for Islam, his mother had not seen him since his arrest.
Two weeks ago, Islam was arrested again, again without charge.
Islam’s brother, Wa’ad is also in prison. Held since April 2008 from the age of 16, his administrative detention has been renewed six times. His father Arafat al-Hidmi said to a media group “They arrested him and said this is an administrative detention meaning his file is secret and no-one can look at it except the Israelis.”
His mother, Fawzia al-Hidmi says of her 18 year old son, “I want my son here so he can do his exams and I can be proud like everyone else who celebrated their children’s graduation.”
Both sons had previously been charged with throwing stones at Israeli troops and affiliation with Islamic Jihad
“The default should always be towards trial and punishment,” said Mark Ellis of the International Bar Association.
“These types of administrative detention can never be a substitute for punishment and trials. Based on the numbers of individuals detained, the Israeli military appears to be using it as the default and that is what makes it in my opinion illegal under international standards.”

Hindutva of Brotherhood is welcome and if Rajnath is willing to modify and preach Brotherhood and equal opportunity to all, let him spell few more sentences and define HIndutva a fresh distancing from the policy of divide on the basis of religion and work to respect the constitution of India and its Secular Credentials.

As the teachings of Islam clearly show us that Brotherhood and unity in Islam are based solely on the `Aqeedah of Islam (which is the foundation of Muslim belief). The Mu’minoon are believers to one another and this belief has nothing to do with race, or any other type of invalid reason to unite but is rather a bond based on an ideological belief in Islam.
Four Schools of Thought – With no Contradiction to Quran and Hadees.
The Four Scholars of Islam strived hard and sacrificed for collecting and presenting true practise of Prophet Mohammed SAS in the in light of the information and sayings of Prophet Mohammed sas and Quran. They all, Imam Abu Hanifa, Imam Malik, Imam Shafia and Imam Hambal did best with at most respect and piety towards beloved Prophet Mohammed sas and the Teaching and Verses of Quran al Hakeem.
Imams Succeeded in Presenting Right Islam.
It is just that, the region they lived and the area they could reach by the means available in the time they lived, thru there students and followers convey the message of Quran and the teachings of Prophet Mohammed sas to greater numbers of people around the world. And they Alhamdulliah Succeeded in presenting the true Islam to the Muslim Umma in compliance with the teachings of Prophet Mohammed and the Verses of Quran with no contradiction.
We are one Umma
They all are True Schools of Thought and they do not contradict the teachings of Prophet Mohammed sas and the Quran. We are expected to respect all the four Imams and there followers. There is no difference among them which contradicts Teachings of Prophet Mohammed and Quran.
Unity is Strength
Unity is strength. This is the reason Islam lays great stress on the importance of unity. The Islamic concept of Towhid is the other name of the unity of humankind. The corner stone in Islam is the unity. Islam teaches us the message that we should not divide humans into sections and sects.
The racial discrimination has been strictly prohibited in Islam. In the last sermon from the Mount of Arafat the Holy Prophet had clearly announced that no Arab has any superiority over a non-Arab; or the white over the black. Islam gives clear injunctions for the respect, safety, security and prosperity of the non-Muslims as well. Unity teaches peace, equality and paternity. The absence of unity brings and breeds disruption, devastation and disputes.
The Quran discusses the concept of unity on three levels. Foremost is the unity of humanity. The Quran in Sura Al-Hujurat (The Inner Apartments) says:
“O, Mankind! We have created you from a male and a female, and made you into nations and tribes that you may know one another. Verily, the most honourable of you with Allah is the one who has piety.” (49:13).
The Quran on second level refers to the unity of the people of the Books: the Jews, the Christians and the Muslims- In Sura Al-e-Imran the Quran says:
” O, people of the Book! Come to a word that is just between us and you, that we worship none but Allah, and that we associate no partners with him, and that none of us will take others as lords besides Allah. Then if they turn away, say; Bear witness that we are Muslims” (3:64).
Then on third level the Quran asserts on the unity of the Muslims. In Sura Al-e-Imran the Quran says;
“And hold fast, all of you together to the rope of Allah, and be not divided among yourselves.” (3:103).
Then Quran condemns sectarianism and regards it shirk (polytheism). The Quran again in Sura Al-e-Imran says:
“O ye who believe! Fear Allah as He should be feared and die not except in a state of Islam.”
This verse clearly ordains that we should strongly adhere to Islam.
Holy Prophet Mohammed sas said; Allah also said; “whoever does not care about the affairs of the Muslims is not one of them.” “The Muslims are like a body; if one limb aches, the whole body aches.”
Muslims must find reasons and means to keep united.
In present day world we have several forces working in several directions as per the means, understanding and motivation they have we only should pray that in rush to do good we should not get deviated from the true path shown by the Prophet Mohammed sas and the Teacings of Quran.
Allah has been kind he in the Qur’an describes what unity in Islam as the Mu’minoon is (Believers are those that believe in Allah and His Messenger Muhammad) being united in a Brotherhood based on solely Islam:
“The Mu’minoon is but a single Brotherhood.” (The Holy Qur’an, 49:10)
Allah further defines this Brotherhood by explaining that Muslims are awliyyaa’ (allies, friends, and supporters) of one another and this again is based solely on Islam:
“The Believers, men and women, are protectors one of another: they enjoin the ma`roof (all of Islam), and forbid the munkar (all that is evil; kufr): they observe regular prayers, pay Zakat, and obey Allah and His Messenger. On them will Allah pour His mercy: for Allah is exalted in power, Wise?” (The Holy Qur’an, 9:71)
Muhammad (Salla Allahu `alaihi wa sallam) indicated in several Ahadith on unity and brotherhood as we can see in his (saaws) Farewell Sermon (khuTbat ul-wadaa`):
“All mankind is from Adam and Eve, an Arab has no superiority over a non-Arab nor a non-Arab has any superiority over an Arab; also a white has no superiority over black nor a black has any superiority over white except by piety and good action. Learn that every Muslim is a brother to every Muslim and that the Muslims constitute one brotherhood.”
And :
“A Muslim is the brother of another Muslim. He does not oppress him, nor does he leave him at the mercy of others.” (Sahih Muslim Book 032, Number 6219)
The Prophet said, “None of you will have faith till he wishes for his (Muslim) brother what he likes for himself.” (Sahih Al-Bukhari Volume 1, Book 2, Number 12)
We should think of applying the Teachings in our LIFE:
We know that the Religion of Islam is complete in the Revelation of Quran and the coming of Prophet Mohammed SAS. All teachings, all guidance, all Commands, All limits and Approvals for Mankind are Complete and Available in the form of Quran and Sayings of Prophet Mohammed sas. We have the protected Quran and Preserved Teachings of Prophet Mohammed in the form Sahih al Bukhari, Sahih Al Muslim, Sahih Al Termizi and few more. And the schools of thought in the form of four Imams which are in compliance to Quran and Hadith.
Put Teaching to Practice
A Great work is needed in the field of calling Muslims to the basics of Islam,
1) Strengthen our Belief in Allah and The Day of Judgement and How we will be asked to give account of our time spent in the life of this world and how only our good deeds are going to stand for us in front of Allah and make us our day on the day of Judgement.
2) Five times Regular Prayers in the Mosques in time. With respect to Sunnah and Nawafil. Zikar, our Mosques need to be full in the Fajr Prayers and not just on Friday Prayers and Ramadan.
3) Reading of Quran and trying to understand it to bring change in our life, and help us understand the world we living better. And try to understand the sayings and teachings of Prophet Mohammed ssa. Our book of guidance should be Quran should be most dear to us.
4) Be a good Mannered Muslim, Transact in our day to day life in full compliance with people around us and our how Allah and the teachings of Prophet want us to. The world should respect us because we are Muslims. We should generate liking form Islam in our fellow human beings, and attract them towards Islam by our manners and deeds and dealings.
5) Pay the Poor Due and Zakat and spend what ever we can in the cause of Allah and to give relief to the poor and the needy in the society and family.
And be thankful to Allah for blessing you that you are expected to give it is very much possible that he could have kept you on the side of receiving zakat and charity.
Think about this it will make you understand the pain and agony and discomfort millions of people in the world are going thru due to lack of food, clothing, and basic needs of life.
This will make us to pay millions of Shuker to Allah for being kind to us for not putting us among in disadvantaged.
6) Be trust worthy and truthful, in all times and be just in all times and
7) Be good to the Parents and Family respect the right of the Parents, Wife, and Children near family and friends, and neighbours.
7) Make our Earning Halal, and Consume only Halal, And Refrain form all that is Haram ( Forbidden)
8) Be the one who cares for mankind and respects the creation of Allah and justify our stand on Islam so that they respect Islam. And never hurt any one unjustly.
9) And never transgerros the limits laid by Allah and His messenger.
